CHIPPEWA FALLS — An Eau Claire man with two previous sex assault convictions pleaded no contest Monday to sexually assaulting a woman at a home in Chippewa Falls and was sentenced to serve another year in jail.
Michael J. Pickerign, 38, 510 Platt St., was convicted of two counts of fourth-degree sexual assault in Chippewa County Court.
Chippewa County District Attorney Wade Newell requested a one-year jail sentence but added that Pickerign wouldn’t get credit for the jail time he’s served since his arrest last year.
“Part of this resolution is he has been on a probation hold for the past eight months,” Newell told Judge Steve Cray. “(The victim) initially asked that the charges be dropped because she didn’t want the defendant to go to prison; she wanted him to get treatment.”
Newell added that the state Department of Corrections and the victim signed off on the agreement.
Pickerign, who has been incarcerated, spoke at the hearing, saying he regrets his decisions and he misses seeing his children.
“I’ve made a lot of mistakes,” Pickerign told Cray. “But I never meant to hurt anyone. I accept full responsibility for my actions.”
Pickerign also must pay $886 in fines and court costs. He will haveHuberworkrelease privileges.
Defense attorney Erika Amundson requested Pickerign be allowed to serve his sentence in the Eau Claire County Jail. She said he will remain on supervision until 2020.
“He knows moving forward he needs to make better choices,” Amundson said.
Pickerign was initially charged with three counts of second-degree sexual assault by use of force and one count of third-degree sexual assault.
A two-day trial, which was slated to begin June 19, was canceled.
According to the criminal complaint, a 32-year-old woman told police Pickerign sexually assaulted her Oct. 20 at a home in the 600 block of West Garden Street in Chippewa Falls. He forced her to have sex with him, she said.
Online court records show Pickerign was convicted of second-degree sexual assault of a child in 2003 in Eau Claire County Court and sentenced to seven years in prison. Pickerign also was convicted of third-degree sexual assault in 2003. The sentence in that case was concurrent to the other conviction.
