MENOMONIE — A Boyceville man is accused in Dunn County Court with sexual assault and domestic abuse.
Shawn L. Smith, 42, was charged Thursday with third-degree sexual assault and knowingly violating a domestic abuse order.
According to the criminal complaint:
At 10:33 Sept. 10, law enforcement was sent to the 800 block of John Street in Boyceville after receiving a domestic disturbance complaint.
Police talked with the victim, who said that during an argument Smith claimed he was legally allowed to force the victim to have sex with him.
The victim later provided a written statement saying that on Sept. 5, after waking up, Smith had sex with the victim without consent.
Smith said he couldn’t remember if he had sex five days earlier, and if he did have sex, he didn’t recall the victim saying “no.”
Smith is scheduled for a pretrial conference Dec. 4.
Currently, Smith is under a domestic abuse injunction in Dunn County until March 20, 2022, prohibiting him from engaging in actions connected to domestic violence.
